Terms of Service
These Terms of Service ("Terms") are an agreement between Mavlon Inc. ("Mavlon," "we," "us," or "our") and the person or organization using our website, technical-drawing analysis, ballooning, and first article inspection automation services ("Customer," "you," or "your").
Agreement and Order of Precedence
By creating an account, starting a trial, signing an order form, or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind it. You must be at least 18 years old.
A signed master services agreement, order form, DPA, security addendum, or other written agreement may supplement these Terms. If terms conflict, the signed agreement controls, followed by the order form, DPA, these Terms, and then referenced policies, unless the signed agreement states otherwise.
The Services
Mavlon uses software and AI-assisted workflows to analyze technical drawings and related documents, identify and interpret inspection characteristics, prepare ballooned drawings, and generate draft first article inspection records and related outputs. Features, supported file types, deployment options, and service levels may vary by plan or order form.
Mavlon outputs are drafts intended to assist qualified engineering and quality personnel. AI-assisted analysis can contain omissions, incorrect interpretations, or other errors. You are responsible for reviewing the source drawing, applicable specifications, customer and regulatory requirements, tolerances, characteristic accountability, inspection results, and every output before approval, release, or submission. Mavlon does not replace professional engineering judgment, inspection, or an authorized quality approval.
Accounts and Authorized Users
You are responsible for maintaining accurate account information, protecting credentials, limiting access to authorized users, and all activity under your account. You must promptly notify Mavlon of suspected unauthorized access or a security incident involving the Services. Mavlon may suspend access when reasonably necessary to protect the Services, Customer Content, other customers, or third parties.
Customer Content and Ownership
"Customer Content" means technical drawings, specifications, notes, part information, inspection requirements, prompts, corrections, files, and other data submitted to the Services, together with outputs generated specifically from that content. As between you and Mavlon, you retain all right, title, and interest in Customer Content.
You grant Mavlon a limited, non-exclusive right to host, copy, transmit, and process Customer Content only as necessary to provide, secure, support, and comply with law in relation to the Services. You represent that you have the rights and permissions needed to submit Customer Content and instruct Mavlon to process it.
No Model Training
Mavlon does not use Customer Content, including drawings, prompts, extracted characteristics, corrections, or outputs, to train, fine-tune, or improve Mavlon models or third-party general-purpose models. Where a commercial AI model provider is used for inference, Mavlon uses services governed by contractual data-protection terms, including a DPA or equivalent protections, and configures the service so Customer Content is not used for provider model training.
Mavlon may use service telemetry that does not contain Customer Content and does not identify a customer to operate, secure, and measure the Services.
Deployment and AI Provider Options
Available deployment options may include a customer-selected Mavlon-managed cloud region, a customer-controlled cloud environment, or an on-premises environment. Supported open-source model configurations are available for qualifying customer-controlled or on-premises deployments. The selected location, model configuration, and allocation of operational responsibilities must be documented in the applicable order form or technical agreement.
Mavlon may use approved sub-processors, including commercial AI model providers, only as needed to provide the configured Services. Mavlon maintains contractual data-protection terms with AI providers that process Customer Content and makes its sub-processor information available on request. Customer-controlled and on-premises deployments may require the customer to operate infrastructure, backups, access controls, model endpoints, or deletion processes.
Trials, Retention, and Deletion
Technical drawings and related Customer Content uploaded for a trial are deleted from Mavlon's active systems within seven days after the trial analysis is completed, unless you begin a paid service or request earlier deletion. Trial content is not used for model training.
For paid Services, retention and deletion follow the order form, DPA, or other customer agreement. If no different period is agreed, Mavlon deletes Customer Content from active Mavlon-managed systems within 30 days after termination or a verified deletion request, subject to legal obligations and the limited lifecycle of isolated encrypted backups. Customers control deletion in customer-controlled and on-premises deployments unless otherwise agreed.
Acceptable Use
You may not:
- use the Services unlawfully or violate third-party rights;
- upload export-controlled, classified, personal, or other restricted data unless the selected deployment is expressly approved for it;
- attempt to gain unauthorized access, bypass security controls, or interfere with the Services;
- introduce malicious code, overload the Services, or conduct security testing without written authorization;
- reverse engineer or copy the Services except where applicable law expressly permits it; or
- use the Services or outputs to build or train a competing model or service without Mavlon's written permission.
Export-Controlled and Regulated Data
Technical drawings may be subject to export controls, contractual restrictions, or sector-specific requirements. You are responsible for classifying Customer Content and selecting an approved deployment, residency, user-access, and model configuration before uploading it. The standard hosted Service is not represented as suitable for classified information or export-controlled technical data unless Mavlon confirms that suitability in a signed agreement.
Fees and Payment
Fees, subscription periods, usage limits, invoicing, taxes, and payment terms are stated in the applicable order form or checkout flow. Except where the agreement states otherwise, fees are non-refundable and subscriptions renew for the stated renewal period until cancelled. Mavlon will provide notice of material pricing changes as required by the applicable agreement or law.
Mavlon Technology and Feedback
Mavlon and its licensors retain all rights in the Services, software, models, interfaces, workflows, documentation, and underlying technology, excluding Customer Content. If you voluntarily provide product feedback, Mavlon may use it without restriction, provided the feedback does not include Customer Content or confidential information.
Confidentiality
Each party will protect the other party's confidential information using reasonable care and use it only to perform or receive the Services. These obligations do not apply to information that is public through no breach, already lawfully known, independently developed, or rightfully received without a duty of confidentiality. A separate NDA or signed customer agreement controls if it provides different terms.
Beta and Preview Features
Beta, preview, pilot, or evaluation features may be incomplete, contain errors, change materially, or be discontinued. Unless an order form states otherwise, they are provided for evaluation and without a service-level commitment.
Suspension and Termination
Either party may terminate as permitted by the applicable order form or agreement. Mavlon may suspend or terminate access for material breach, non-payment, unlawful use, or a security threat, subject to any notice and cure rights in the agreement. Provisions that by their nature should survive termination will survive, including ownership, confidentiality, payment obligations, warranty disclaimers, and limitations of liability.
Disclaimers
Except for warranties expressly stated in a signed agreement, the Services and all AI-assisted outputs are provided "as is" and "as available." To the maximum extent permitted by law, Mavlon disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that outputs will be complete, error-free, or satisfy every customer, regulatory, or industry requirement.
Limitation of Liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or business interruption, arising from the Services. Any liability cap or excluded claims stated in a signed agreement will control. Where no signed agreement provides a cap, Mavlon's aggregate liability arising from the Services will not exceed the fees paid or payable for the affected Services during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot lawfully be limited.
Changes to These Terms
We may update these Terms to reflect changes in the Services or law. We will post the revised Terms and update the date below. If a change materially reduces your rights during a current paid term, we will provide notice as required by the applicable agreement or law.
